Terms & Conditions

This document (“Terms”) governs the use of bettaqua.gr (the “Website”) and the purchase of products and services through its online store (the “Store”). By browsing the Website and/or placing an order, you (“Customer” or “User”) accept these Terms.

These Terms are drafted in line with Greek and EU law, including (indicatively): Greek Consumer Law Law 2251/1994, the E-Commerce Directive 2000/31/EC (as implemented in Greece), the Consumer Rights Directive 2011/83/EU, the GDPR (EU) 2016/679, Greek Law 4624/2019, the Sale of Goods Directive (EU) 2019/771, and the ADR/ODR framework (Regulation (EU) 524/2013 and Directive 2013/11/EU) where applicable.

Terms & Conditions - The Basics 

1. Definitions

  • “Company”: the legal entity operating bettaqua.gr.

  • “Website/Store”: bettaqua.gr and its e-commerce services.

  • “Products”: goods sold through the Store (including live organisms where offered).

  • “Order”: purchase request submitted by the Customer.

  • “Contract”: the distance sales contract concluded between Customer and Company.
     

2. Scope & Availability
2.1 The Store offers aquarium-related goods and related services, including but not limited to: fish, aquatic plants, aquariums, filters, heaters, lighting, food, water treatment, accessories, spare parts, and related items.
2.2 The Company may update the Website, product assortment, pricing, content, technical features, or availability at any time.
2.3 Product images and descriptions are indicative. Minor differences (packaging, color, manufacturer updates) may occur without constituting defect, unless legally material.

3. Eligibility & User Responsibilities
3.1 By using the Store, you declare that you have legal capacity to enter into a binding contract (generally 18+).
3.2 You agree to provide true, accurate, and complete information (name, address, phone, VAT details for invoicing etc.). You are responsible for any consequences arising from incorrect data (e.g., failed delivery, extra costs).
3.3 You must use the Website lawfully and must not:

  • attempt unauthorized access, scraping, or disruption,

  • introduce malicious code,

  • infringe intellectual property rights,

  • make fraudulent or abusive transactions.

3.4 The Company may restrict access, suspend accounts, or refuse orders where fraud, abuse, or violations are suspected.

4. Information, Advice & No Professional Guarantee
4.1 Any guidance provided (product descriptions, “tips”, fish compatibility notes, aquarium care advice, blog content, chat responses) is general information and not a guarantee of results.
4.2 Aquarium husbandry outcomes depend on many factors (water parameters, cycling, filtration, stocking, acclimation, disease, transport stress). The Customer bears responsibility for the suitability of purchases and the environment of use.

5. Prices, Taxes & Errors
5.1 Prices are shown in EUR (€). VAT inclusion/exclusion is shown at checkout.
5.2 Shipping costs and any cash-on-delivery charges are shown before the order is finalized.
5.3 Pricing/technical errors: If a Product is displayed with an obvious error (e.g., incorrect price, wrong availability), the Company may correct it and may cancel the order and refund paid amounts, even after confirmation, to the extent permitted by law.

6. Ordering Process & Contract Formation
6.1 Orders are placed electronically through the checkout process.
6.2 An automated order confirmation email means “order received” and does not necessarily mean “order accepted”.
6.3 The Contract is concluded when the Company:

  • confirms acceptance and/or ships the Products, and

  • receives valid payment authorization where applicable.

6.4 The Company may refuse/cancel an Order for legitimate reasons, including:

  • out-of-stock or supplier failure,

  • pricing/technical error,

  • payment failure,

  • suspicious activity/fraud,

  • inability to deliver to the provided address,

  • force majeure.

Refunds are issued according to the applicable payment method and legal requirements.

7. Payments
7.1 Payment methods: card, bank transfer, cash on delivery, and/or other methods shown at checkout (---).
7.2 Payments may be processed through third-party payment providers. The Company does not store full payment card data (subject to the provider’s compliance and security).
7.3 For bank transfers, the order may be processed after funds clear. Any bank fees are borne by the Customer unless stated otherwise.

8. Shipping, Delivery, Risk & Inspection
8.1 Delivery times are estimates. Delays may occur due to courier operations, peak periods, weather, strikes, remote areas, and other factors.
8.2 The Customer must ensure:

  • correct delivery details,

  • availability to receive the package,

  • compliance with any courier requirements.

8.3 Risk transfer: Risk of loss or damage transfers upon delivery to the Customer (or to a person designated by the Customer), without affecting mandatory consumer rights.
8.4 Inspection: Upon receipt, the Customer must promptly inspect the package and Products. Visible damage should be reported immediately to the courier and to the Company with evidence (photos) as soon as possible.

9. Special Terms for Live Animals & Live Plants (If Offered)
9.1 Live animals/plants are sensitive goods. Even with proper packaging, transport involves inherent risk.
9.2 The Company’s responsibility is limited to proper preparation/packing and dispatch under reasonable standards.
9.3 The Company is not liable for losses or negative outcomes caused by:

  • courier delays or mishandling,

  • extreme temperatures during transit or at the delivery location,

  • refusal/absence at delivery,

  • improper acclimation,

  • unsuitable tank conditions (cycling, ammonia/nitrite, pH, temperature),

  • incompatibility between species,

  • disease outbreaks after delivery.

9.4 If you report DOA (“dead on arrival”) or severe condition issues, you must:

  • notify the Company within --- hours of delivery,

  • provide clear photos/video and the delivery label,

  • follow the Company’s claim procedure.

9.5 Where the law permits, the Company may offer replacement/credit at its discretion after verification, and may exclude claims where evidence indicates improper handling or unsuitable conditions.

10. Right of Withdrawal (Distance Sales) & Exceptions
10.1 If you are a consumer, you may have a statutory right to withdraw from the Contract within 14 calendar days from delivery, under Directive 2011/83/EU and Greek implementing rules, unless an exception applies.
10.2 To withdraw, you must notify the Company in writing (email) and return eligible items in unused condition, in original packaging, with all accessories and documents, within the statutory timeframe.
10.3 Return shipping costs are borne by the Customer unless the law requires otherwise or the Company explicitly agrees otherwise.
10.4 Exceptions (non-returnable items) may include, as permitted by law:

  • live animals and live plants,

  • sealed goods unsealed after delivery (hygiene/health protection),

  • perishable goods,

  • custom-made or clearly personalized items,

  • opened consumables (e.g., fish food) where resale is not possible.

10.5 Refunds are processed after inspection and within the legal timeframe, using the original payment method unless otherwise required or agreed.
11. Defects, Legal Guarantee & Remedies
11.1 For consumer goods, the Customer’s rights are governed by the Sale of Goods Directive (EU) 2019/771 as implemented in Greece and any mandatory Greek civil/consumer rules.
11.2 If a Product is defective or non-conforming, the Customer may be entitled to repair, replacement, price reduction, or contract termination as provided by law, depending on circumstances.
11.3 The Company may request reasonable evidence of defect and may require return of the Product for inspection.
11.4 Misuse, improper installation, modification, wear and tear, or failure to follow instructions may exclude liability to the extent permitted by law.

12. Limitation of Liability (General)
12.1 To the maximum extent permitted by law, the Company is not liable for indirect, consequential, or special damages (loss of profits, loss of data, aquarium stock loss, etc.).
12.2 Total liability, where permitted, shall not exceed the purchase price of the Product(s) that gave rise to the claim.
12.3 Nothing in these Terms limits liability where such limitation is prohibited by mandatory law (e.g., intentional misconduct, gross negligence where applicable, or non-excludable consumer rights).

13. Intellectual Property
All content on bettaqua.gr (text, images, branding, logos, graphics, database, design, software) is protected by intellectual property laws and belongs to the Company or its licensors.
No reproduction, distribution, or commercial use is allowed without prior written consent.

14. Third-Party Links & Services
The Website may include links or integrations to third parties (couriers, payment gateways, social media, marketplaces). The Company is not responsible for third-party terms, content, or performance.

15. Privacy & Cookies
Processing of personal data is governed by:

  • GDPR (EU) 2016/679,

  • Greek Law 4624/2019,

  • applicable ePrivacy rules (including Greek Law 3471/2006 where relevant).

Please consult the Privacy Policy and Cookie Policy on the Website (each forms part of these Terms).

16. Force Majeure
The Company is not liable for failure or delay due to events beyond reasonable control, including: natural disasters, extreme weather, strikes, war, government measures, supplier failure, transportation disruptions, large-scale IT outages, or courier network failures.
If force majeure persists beyond a reasonable period, the Company may cancel affected orders and issue refunds where required.

17. Amendments
The Company may update these Terms at any time. The version published on the Website at the time of purchase governs that transaction, unless mandatory law provides otherwise.

18. Governing Law & Jurisdiction
These Terms are governed by the laws of Greece and applicable EU law.
Disputes shall be subject to the competent courts of ---, unless mandatory consumer rules provide otherwise.

19. Alternative Dispute Resolution (ADR/ODR)
If you are a consumer, you may be entitled to use out-of-court dispute resolution mechanisms under Directive 2013/11/EU and the EU’s online dispute resolution platform under Regulation (EU) 524/2013, where applicable.
